OLIVYX sells cosmetic products whose main characteristics, contents, instructions for use and relevant information are described in the corresponding product sheets.

Images and graphic representations are for informational purposes. There may be minor variations in the external appearance, colour or presentation of products or packaging that do not affect their essential characteristics.

Under no circumstances will a purchased product be replaced with a different one without the customer’s consent.

All orders are subject to availability.

If, after an order has been placed, it is exceptionally found that any of the products is unavailable, OLIVYX will inform the customer as soon as possible.

Where it is not possible to supply the contracted product, the corresponding amounts paid will be refunded using the same payment method used for the purchase, at no cost to the consumer.

The applicable prices shall be those shown on www.olivyx.es at the time the order is placed.

Prices shown to the consumer will include legally applicable taxes, unless expressly stated otherwise.

Before completing the purchase, the total order amount will be shown, including taxes and, where applicable, shipping costs or other applicable charges.

OLIVYX may modify prices, promotions and commercial terms for future purchases, without such changes affecting orders already placed.

Promotions and discount codes shall be subject to the specific conditions communicated in each case.

Unless expressly stated otherwise, promotions are not cumulative.

Where a promotion depends on:

  • a minimum purchase amount;
  • the joint purchase of certain products;
  • a specific number of units;
  • a pack;
  • a 2-for-1 or similar promotion; or
  • any other objective condition,

a later partial return may lead to recalculation of the promotion on the products ultimately kept by the customer.

Any recalculation shall be made in accordance with the promotion conditions communicated before the purchase and shall not constitute a penalty for exercising the right of withdrawal.

Courtesy free samples need not be returned.

Gifts or products linked to a promotion must be returned where, as a result of a return, the conditions entitling the customer to receive them are no longer met.

To make a purchase, the user must:

  • Select the products they wish to buy.
  • Add them to the cart.
  • Review the products, quantities and prices.
  • Enter or confirm the data required to process the order.
  • Select, where applicable, the available shipping and payment method.
  • Review the final summary of the transaction.
  • Accept the applicable terms.
  • Confirm the order using the button intended to complete the purchase.

Before confirming the order, the user may review and correct the data entered.

The button or function used to complete the order will clearly indicate that activating it creates an obligation to pay.

These General Terms will be available before completing the purchase and may be stored and reproduced.

The contract may be concluded in Spanish and, where available on the website, in the other languages offered by OLIVYX.

Once the purchase has been completed correctly, OLIVYX will send the customer a confirmation to the email address provided during the process.

The confirmation will include the information needed to identify the order and will be sent within the periods established by law.

The customer should check the details in the confirmation and report any error as soon as possible.

The customer may use the payment methods enabled and indicated in the purchase process.

Available payment methods will be shown before the customer becomes bound by the order.

Payment will be processed through the corresponding payment service providers with the applicable security measures.

OLIVYX will not have access to full bank card details where these are processed directly by the payment provider.

Orders placed through www.olivyx.es are currently delivered to:

  • Mainland Spain and the Balearic Islands.

Shipments are not currently made to the Canary Islands, Ceuta or Melilla.

Territorial delivery restrictions will also be shown during the purchase process.

Applicable shipping costs will be indicated before the customer confirms and pays for the order.

There may be temporary or permanent free-shipping promotions subject to the conditions stated on the website at the relevant time.

The exact shipping amount applicable to the order will be visible before completing the purchase.

Delivery will be made to the address indicated by the customer during the purchase process.

Estimated delivery times will be indicated during the purchase process or in the corresponding shipping information.

Unless the parties expressly agree otherwise, delivery will be made without undue delay and, in any event, within the maximum period established by law.

The customer is responsible for providing a complete and correct address.

Where transport is arranged by OLIVYX, the risk of loss of or damage to the products shall remain with OLIVYX until the consumer or a third party indicated by the consumer, other than the carrier, acquires physical possession of the products.

Therefore, any damage suffered by the product before its effective delivery may be reported to OLIVYX in accordance with the incident procedure provided.

If the order arrives damaged, incomplete, contains incorrect products or presents any other issue, the customer must contact:

info@olivyx.es

OLIVYX may request photographs or other information reasonably necessary to verify and resolve the issue.

It is recommended that visible damage occurring during transport be reported within the first 48 hours of receipt to facilitate handling, without such period limiting the consumer’s legal rights.

It is not mandatory to check the contents of the order in the presence of the carrier.

The customer must reasonably facilitate delivery of the order.

Failure to collect an order or refusal of delivery does not, by itself, constitute formal notice of exercise of the right of withdrawal.

Where an order is returned to OLIVYX for reasons attributable to the recipient, such as repeated absence, failure to collect within the carrier’s deadline, incorrect delivery details provided by the customer or unjustified refusal of delivery, OLIVYX may claim or deduct, where legally permitted, the direct and actual costs caused by the return of the shipment, without applying additional penalties.

The rights legally recognised for consumers, including the right of withdrawal, shall in all cases remain guaranteed.

The customer may request cancellation by writing to info@olivyx.es.

Where the order has not yet been dispatched, OLIVYX may cancel the transaction and refund the amounts paid in full.

Once dispatched, the request will be handled in accordance with the right of withdrawal and the Returns and Refunds Policy.

Consumers have 14 calendar days from receipt of the order to withdraw from their purchase in whole or in part without stating a reason.

Where an order includes several products delivered separately, the period begins on receipt of the last item.

Communication may be made by an unequivocal statement sent to:

info@olivyx.es

Once withdrawal has been notified, the consumer must return the products within the following 14 calendar days to:

VI-BAC SOLUTIONS, S.L.

C/ Lorenzo Estepa, nave 55

14500 Puente Genil, Córdoba

Spain

The direct costs of return shall be borne by the consumer.

Full information on the withdrawal procedure is available in OLIVYX’s Returns and Refunds Policy.

In accordance with applicable law, the right of withdrawal shall not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.

Therefore, where an OLIVYX cosmetic product has a seal or first-opening guarantee system, it must remain intact in order to exercise withdrawal where this legal exception applies.

This limitation shall not affect the consumer’s rights where there is a defect, lack of conformity or issue attributable to OLIVYX.

Where a refund is due, it will be made using the same payment method used for the purchase, unless expressly agreed otherwise in a way that does not generate costs for the consumer.

In the event of total withdrawal, the costs corresponding to the least expensive ordinary delivery method offered by OLIVYX will also be refunded.

Any surcharge corresponding to a delivery method expressly chosen by the consumer that is more expensive than the cheapest ordinary method available will not be refunded.

OLIVYX will make the refund without undue delay and, in any event, within the maximum legal period of 14 calendar days from being informed of the decision to withdraw.

However, OLIVYX may withhold the refund until:

  • it has received the returned products; or
  • the consumer provides sufficient proof of having sent them,

whichever occurs first.

Once the goods have been received, OLIVYX may check the condition of the products and verify that the applicable return conditions are met.

Internal administrative review and approval of the return shall in no case extend the legally established periods for making the refund.

VI-BAC SOLUTIONS, S.L. is liable to the consumer for any lack of conformity of the goods in accordance with applicable law.

For new goods, legal liability for any lack of conformity existing at the time of delivery that later becomes apparent shall extend for the period established by applicable legislation, currently three years from delivery.

Where there is a lack of conformity, the consumer shall be entitled to the remedies established by law, according to the circumstances of each case.

Measures aimed at bringing the product into conformity shall be free of charge for the consumer where legally required.

For any enquiry relating to an order, incident, return or complaint:

info@olivyx.es

OLIVYX will endeavour to resolve any issue diligently and in accordance with applicable law.

These terms apply only to purchases made directly through www.olivyx.es.

Purchases made through Amazon, marketplaces, physical stores, distributors or third parties shall be subject to the contract and purchase procedure of the relevant seller, without prejudice to the rights legally recognised for consumers.

Nothing in these terms is intended to exclude or limit rights that legislation recognises as mandatory for consumers and users.

OLIVYX shall not be liable for breaches arising from circumstances beyond its control where a legally recognised ground excluding or limiting liability applies.

VI-BAC SOLUTIONS, S.L. may amend these General Terms to adapt them to legislative, technical, commercial or store-operation changes.

Amendments shall apply only to orders placed after they come into force.

Orders already placed shall be governed by the terms accepted at the time of purchase.

These terms shall be governed by Spanish law and by applicable European Union legislation.

In relations with consumers, any dispute shall be submitted to the courts with jurisdiction under applicable law, always respecting the consumer’s legal forum.

Consumers shall not be contractually required to submit to courts other than those to which they are legally entitled.

These General Terms must be interpreted together with:

  • the Legal Notice;
  • the Privacy Policy;
  • the Cookie Policy; and
  • the Returns and Refunds Policy

published on www.olivyx.es.

In the event of conflict, the mandatory rights recognised for consumers under applicable law shall prevail.
